How does Louisiana decide child custody?
Louisiana courts use the “best interest of the child” standard. Judges weigh the emotional ties between each parent and the child, each parent’s capacity to provide love and guidance, the child’s adjustment to home, school and community, the health of everyone involved, and each parent’s willingness to support the child’s relationship with the other parent.
How long does a no-fault divorce take in Louisiana?
Spouses must live separate and apart for 180 days without minor children, or 365 days with minor children, after filing. Fault grounds — including adultery, a felony conviction with hard labor, or abuse of a spouse or child — follow a different path and can affect spousal support.
How do I get a protective order?
You file a petition describing the abuse or threat. If there is immediate danger, the court can issue a Temporary Restraining Order the same day, without the abuser present. A hearing on a full protective order is held within 21 days, and an order can last up to 18 months.
